BOSS Audio International (hereon referred to as “B.I.G.”, “we”, “us” or “our”) and its subsidiary companies respect your privacy rights and recognize the importance of protecting the information collected from you. This global Privacy Policy (“Privacy Policy”) details how we collect, store, and use the information you provide online. In this Privacy Policy, we refer to our website and the services provided through them together as our “Online Services.” Please note that this Privacy Policy applies only to sites maintained by B.I.G. and its subsidiaries, and not to websites maintained by other companies or organizations to which we link.  This Privacy Policy applies to all users of our Online Services and covers what information we collect and why we collect it, how we use the information we collect, the measures we take to protect the security of the information, the choices you have to access and update that information, and how you can contact us about our privacy practices.

 

Please note that our Privacy Policy is supplemented by additional provisions that apply to California residents. These additional provisions, if applicable to you, are part of our Privacy Policy. By using our Online Services, you expressly consent to our collection, use, disclosure, and retention of your personal information as described in this Privacy Policy. This Privacy Policy may be updated from time to time and each time you use our Online Services, the then-current version of this Privacy Policy will apply.

  1. INFORMATION WE COLLECT

We collect two basic types of information – personal information and anonymous information – and we may use personal and anonymous information to create a third type of information, aggregate information. Personal Information means information that identifies (whether directly or indirectly) a particular individual, such as the individual’s first and last name, or e-mail address. Anonymous Information means information that does not directly or indirectly identify, and cannot reasonably be used to identify, an individual. Aggregate Information means information about groups or categories of individuals which does not identify and cannot reasonably be used to identify an individual. We may share Aggregate and Anonymous Information with other parties without restriction.

    1. Information that You Provide to Us

When you interact with our Online Services, we may collect certain Personal Information directly from you. The information that you provide to us may include the following:

      1. Information Collected Upon Registration: If you desire to have access to certain restricted sections of our website, you will be required to become a registered user, and to submit certain Personal Information to B.I.G., including your IP address, full name, password, email address, city, time zone, telephone number, and other information that you decide to provide us with, or that you decide to include in your public profile. 

      2. Contact Information: which generally includes your name, addresses, email addresses, social media website user account names, third party ticketing service user account names, and/or telephone numbers.

      3. Payment Information: where needed to process payments and generally includes your credit or debit card number, expiration date, and card verification number.

      4. Customer Service Information: If you use any of our customer service features (such as the customer service chat), we collect information related to the chat time, duration, participants, and contents.

      5. Information You Provide in Public Forums Available in Our Online Services: We may offer public forums that do not have restricted access. If you provide Personal Information when you use any of these features, that Personal Information may be publicly posted and otherwise disclosed without limitation as to its use by us or by a third party.       6. Physical Location: your physical location that can be derived from your IP address, GPS coordinates, your interactions with our emails, or use of our mobile application, depending on your preferences that you set up on your devices.

    1. Information that is Automatically Collected from You

When you use our Online Services, we may obtain certain information by automated means. B.I.G. may use a variety of technologies to collect this information, such as browser cookies, flash cookies, web beacons, mobile device identifiers, server logs, and Adobe Flash technology and other tracking technologies. We may collect and analyze information, including but not limited to browser type, ISP or operating system, domain name, access time, referring or exit pages, page views, IP address, geolocation, unique device identifiers (e.g. IDFA or Android ID), and the type of device that you use. We may also track when and how frequently you access or use the Online Services, including how you engage with or navigate our website or product offerings. This may include information about how you use our Online Services, such as the types of content you view or engage with, the features you use, the actions you take, and the time, frequency and duration of your activities.

We use a variety of technologies to collect this information automatically.

      1. Cookies: Cookies are small files downloaded to your computer to track movements within websites. We use cookies and other technologies to passively collect demographic information, personalize your experience on our site and monitor advertisements and other activities. We may link cookie information to personal information regarding what items you have selected for purchase, or to track pages you have viewed, to build your shopping cart, to customize ads, content, or offers on our Online Services; and to conduct market research and measurement in order to improve our websites, content, and Online Services and to make our websites, content, and Online Services more useful for users. We also use cookies to deliver content specific to your interest and to monitor website usage. Some of our sites use an outside ad service to display ads. These ads may contain cookies. Our ad companies collect cookies received with banner ads, and B.I.G. does not have access to this information. Please note that this Privacy Policy covers the use of cookies by B.I.G. only and does not cover the use of cookies by any advertisers. Most browsers are automatically set to accept cookies whenever you visit a website. You can disable cookies or set your browser to alert you when cookies are being sent. Visit www.allaboutcookies.org/manage-cookies to enable/disable cookies. Disabling cookies that are necessary for website’s proper operation may result in the web page not loading, or not operating as expected. Disabling cookies that remember your preferences or analytics, will prohibit us from providing you with relevant information. If you disable all cookies (including the essential ones), then you won’t be able to access all parts of our website.

      2. Log Data: When you visit our site, our servers automatically record information that your browser sends as Log Data. This Log Data may include information such as your IP address, browser type or the domain from which you are visiting, the websites you visit, the search terms you use, and any advertisements on which you click. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. We use Log Data to monitor the use of the Site and of our Service, and for the Site’s technical administration.

      3. Location Tracking: If you access our Online Services from a mobile or other device, we may collect a unique device identifier assigned to that device (UDID) that will give us information about the type of device you are using and its general location. This allows us to improve the Online Services delivered to you

      4. Clear GIF’s: Clear GIF’s, also known as web bugs, beacons, or tags, are small graphic images placed on a web page, web-based document, or in an e-mail message. Clear GIF’s are invisible to the user because they are typically very small (only 1×1 pixel) and the same color as the background of the web page, document, or e-mail message. We do not use clear GIF’s to collect Personal Information about you. However, we may use clear GIF’s to capture statistical usage information for our web pages, features, or other elements on a web page. We may correlate this information to a user to personalize user experience or for statistical analysis of user experiences on our web pages. 

    1. Information Collected from Other Sources

We may obtain information from other sources, including social networks that you use to connect with us. This may include Personal Information provided by you to these networks, such as name, username, contact information, demographic information, and interests. This may also include Personal Information that can be publicly observed through social media and other forms of online activity.

  1. B.I.G.’s USE OF THE INFORMATION WE COLLECT.

Our primary goals in collecting Personal Information are to provide you with the product and Online Services made available through our website, including, but not limited to, service and sales transactions, to communicate with you, and to manage your registered user account if you have one. To do so, we may use the information that obtain in one or more of the following ways:

    1. To provide you with the Online Services;

    2. To manage and remember your preferences and personalize the Online Services;

    3. To solicit input and feedback to improve our Online Services and to deliver customized content and offers to you, which include special promotions, product information, loyalty programs, and sales;

    4. To inform you about new products or promotional offers, or other opportunities which we feel will be of interest to and provide you with information about, our products and Online Services;

    5. To process payments and to send you emails, receipts, and alerting you if we need different or updated payment card information;

    6. To address problems with our website, products, or Online Services, to protect the security of our website and our business, and to improve our customer’s experience;

    11. To prevent fraud or potentially illegal activities, enforce the Terms of Service that apply to our Online Services or to comply with applicable law;

When legally required, such as to respond to legal requests (e.g., court or government agency order, subpoena, etc.), to resolve disputes, enforce agreements, and to comply with a legal obligation. We may also use your Personal Information where necessary to facilitate a potential transaction, such as a merger, acquisition, or asset sale; and

    13. For internal purposes such as auditing, data analysis, and research to improve our products, services, and communications.

  1. SHARING INFORMATION WITH THIRD PARTIES.

We may share your Personal Information with third-parties in the following circumstances:

    1. Service Providers: We provide access to or share your Personal Information with select third-parties who perform services on our behalf. These services may include data storage, analytics and data analysis, billing, content delivery services, customer relationship management (CRM) vendors, marketing, product content and features, customer service, data storage, fraud prevention, legal services, maintenance, hosting, security, payment processing, email and text message distribution, and surveys. These third parties have access to your Personal Information only to perform tasks on our behalf and are obligated not to disclose or use it for any other purpose. We use reasonable efforts to review third parties for their privacy and data security practices, and generally require that such third parties agree to protect the Personal Information we share.

    2. Analytics: We may share your Personal Data with third-party analytics providers to monitor and analyze how our Services and features are being used. The analytics providers track and report website traffic and use this information to monitor the use of our Service. To opt out of use of third party cookies that share data with these analytics providers, follow the steps described in Section IV of this Policy.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

    1. Consent/At Your Direction: We may disclose your Personal Information to affiliated and nonaffiliated third-parties based on your consent. The sharing of your Personal Information includes the disclosure of your Personal Information in order to facilitate the purchase of B.I.G. products through the Online Services; to respond to your requests for customer service; when we have your permission; or as described in this Privacy Policy, the Terms of Service, or any other legal terms governing your use of the Online Services.

    2. To Protect Our Company or Our Community: We may disclose your Personal Information to law enforcement where we believe our Online Services are being used in the commission of a crime, including to report such criminal activity or to exchange information with other companies and organizations for the purposes of fraud protection and risk management or when we have a good faith belief that there is an emergency that poses a threat to the health and/or safety of you, another person, or the public generally.

    3. Business Transfer: In connection with or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company, we may share information about our customers, including your Personal Information, to the successor company.

    4. Our Subsidiaries: We may share Personal Information about you with B.I.G.’s subsidiaries and affiliates and companies acquired by or merged with B.I.G. and its affiliates, including without limitation, to enable such acquired or merged companies to advertise to you products and services in which you may be interested.

    5. Non-Personal Aggregate/Anonymous Information: We may share aggregated anonymous information about use of the Online Services, such as by creating reports on usage trends. This non-personal information may be shared with third-parties who may use the data for their market research and measurement purposes.

    6. Other Purposes: We may share your Personal Information for any other purpose(s) disclosed to you at the time we collect your information or with your consent.

  1. MARKETING COMMUNICATIONS

B.I.G. may use your Personal Information, including any inferences we infer about you using such information to contact you with newsletters, marketing or promotional materials, to identify your preferences and tailor our content and recommendations for you, send you personalized advertising and marketing related communications about our Services, new products and other news about our company. You may opt-out of receiving any, or all, of these communications from us. If you decide at any time that you no longer wish to receive such information or communications from us, please follow the unsubscribe instructions provided in any of the communications or by following the instructions contained in Section 6(f).

For information about interest-based advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website. To prevent cookies from being put on your computer to deliver tailored marketing, you may visit the Network Advertising Initiative's (“NAI”) Consumer Opt-Out Link and/or the Digital Advertising Alliance's (“DAA”) Consumer Opt-Out Link to opt-out of receiving tailored advertising from companies that participate in those programs. To opt out of Google Analytics for Display Advertising or customize Google Display Network ads, you can visit the Google Ads Settings page. Please note that to the extent advertising technology is integrated into the Online Services, you may still receive advertising content even if you opt out of tailored advertising. In that case, the advertising content will just not be tailored to your interests. Also, we do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. If your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different computer or change web browsers, your NAI or DAA opt-out may no longer be effective.

  1. YOUR CHOICES REGARDING THE DATA WE COLLECT AND USE

You have certain rights and choices with respect to your Personal Information such as:

    1. Delete your Account: You may delete your account by reaching out to customer support and requesting us to delete your account. You may also reach out to customer support and ask us to erase or delete all or some your Personal Information (for example, if it is no longer necessary to provide Online Services to you);

    2. Profile Information: You can update your profile information by accessing your account.

    3. Cookies & Analytics: You can opt out of certain cookie-related and analytics processing by following the instructions set forth above in Section 1(b)(i).

    4. Object to, Limit or Restrict use of Personal Data: You may ask us to stop using all or some your Personal Information (for example if we have no legal right to keep using it) or to limit our use of it (for example, of your Personal Information is inaccurate or unlawfully held);

    5. Sharing Personal Information: You may choose whether to share your Personal Information with other companies so they can send you offers and promotions about their products and services;

    6. Marketing Communications & Opting-Out: At any time, you may “opt-out” of receiving e-mail marketing materials by sending us an e-mail with “unsubscribe” as the subject to privacy@bossaudio.com. You may also call us directly at 805-751-4853. You will also be able to find an “unsubscribe” link in every relevant e-mail communication you receive from BIG. Please note that non-marketing e-mails, such as order confirmations, will still be sent to you and that we will retain your Personal Information even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, respond to government investigations, maintain security, prevent fraud and abuse, enforce our Terms of Service or other terms or policies, and protect our and others’ rights. We will retain Anonymous Information and Aggregate Information after your account has been closed. Because we do not control data you shared with others, such data will remain visible or accessible.

  1. HOW WE STORE YOUR INFORMATION

    1. Security of Your Information

The security of your Personal Information, is important to us. We implement technical, physical and organizational security safeguards designed to protect your data from loss, misuse and unauthorized access and disclosure. While we strive to use commercially acceptable means to protect your Personal Information, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee that your Personal Information is absolutely safe from intrusions by others. Furthermore, we are not responsible for any breach of security caused by, or for any actions of, any third parties that receive the Personal Information.

    1. Retention of Your Information

We will retain your Personal Information only for as long as is necessary for providing the Online Services and for the purposes set out in this Privacy Policy, including to comply with our legal obligations (for example, if we are required to retain your Personal Information to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. Additionally, if your B.I.G. product is under warranty, we will retain your Personal Information for the duration of the warranty period.

If you delete your account, we will immediately cease all marketing communications (to the extent you have not already adopted out), and will no longer store any of your Personal Information for a marketing purpose. If you delete or deactivate your account, or if your account is terminated, and retention of you Personal Information is no longer necessary, we will delete your data within 90 days.

  1. CHILDREN

The Online Service are bot directed to individuals under the age of eighteen (18) and we do not knowingly collect or use any Personal Information from such individuals. If you are a parent and believe we may have inadvertently collected such information from your child, please notify us immediately by sending an email to privacy@bossaudio.com

We are only responsible for the privacy policy contained on our own website. At times, we may have links to other sites or apps contained on our website that have different privacy policies from our own. You acknowledge that B.I.G. is not held responsible for any site that is not a B.I.G. property. If you follow a link to any of these websites, please note that these websites, and any services that may be accessible through them, have their own privacy policies. We are not responsible for the privacy practices of other websites. We encourage our users to be aware when they leave the Online Services and to read the privacy policies applicable to such third-party websites. This Privacy Policy applies solely to information collected in connection with the Online Services.

  1. CHANGES TO THE POLICY

We may occasionally update this privacy policy due to changes in the law or in the services we offer. We will update the effective date of the Privacy Policy at the time a change is made. We will notify you of any changes by posting the changes on our website or via email if you opted-in our mailing list. The revised Privacy Policy will become effective when we notify you of the revised Privacy Policy. Your use of the Online Services following these changes means that you accept the revised Privacy Policy.

We are providing the following additional details regarding the Personal Information that we collect, use, and disclose about California residents.

Under the California Consumer Privacy Act (“CCPA”), California Civil Code Section 1798.83, as amended by the California Privacy Rights Act (“CPRA”) users who are California residents have specific rights regarding their Personal Information. These rights are subject to certain exceptions described below. When required, B.I.G. will respond to most requests within 45 days unless it is reasonably necessary to extend the response time.

    1. Right to Delete Personal Information

You have the right to request that B.I.G. delete any of your Personal Information collected from you and retained, subject to certain exceptions. Upon receiving a verified request to delete your Personal Information, B.I.G. will do so unless otherwise authorized by law.

If you find that we maintain any inaccurate Personal Information, you have the right to request that we correct such inaccuracy.

    1. Right to Limit Use of Sensitive Personal Information

You have the right to instruct us to limit our use of your Sensitive Personal Information to that which is necessary to provide the Services. Right to Opt Out of Sales of Personal Information

You have a right to opt-out of the sale of your Personal Information. You may, at any time, direct businesses that sell your personal information to third parties not to sell your personal information. You may do so by either contacting us as detailed below or by clicking on the “Do not sell or share my Personal Information” link in the footer of our website.

You may also call us directly at 805-751-4853. We will respond to verifiable requests for disclosure or deletion of Personal Information free of charge, within 45 days of receipt.

In order to protect your privacy and the security of their information, B.I.G. verifies consumer requests by requesting certain account information. Any additional information you provide will be used only to verify your identity and not for any other purpose.

You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent written permission to submit a request on your behalf, and B.I.G. may require that they verify their identity directly with B.I.G.. Alternatively, an authorized agent that has been provided power of attorney under Probate Code sections 4000-4465 may submit a request on your behalf.

    1. Right to Non-Discrimination

You have the right not to be discriminated against for the exercise of their California privacy rights described above.

Shine the Light: Under California Civil Code Section 1798.83, California residents have the right to request a list of the categories of information that have been disclosed to third parties for the third parties’ direct marketing purposes in the past year. Additionally, California residents have the right to request a list of the names and addresses of all such third parties to whom we have disclosed personal information for the third parties’ direct marketing purposes, during the past 12 months. We do not disclose personal information to third parties for their direct marketing purposes.
